海口知识产权法庭开启“云间”调解模式，战“疫”审判两不误
当前，正值全国战“疫”进入关键时刻。为切实做好防控疫情与审判工作两不误，2月27日上午，海口知识产权法庭依托互联网技术，对原告广州市某机械设备有限公司分别诉9家商行侵害外观设计专利权纠纷系列案进行了“云间”调解。
这9件系列案的原告位于广州市，代理人也居住在广州，为避免人员集聚发生交叉感染的风险，同时满足当事人在疫情防控期间的诉讼需求，本着“平安健康第一、高效处理纠纷”的原则，合议庭成员审判长杜蕾、审判员何静、张慧在征得当事人的同意后，决定通过互联网庭审系统进行在线调解。合议庭随即启动准备工作，快速联系技术人员对法庭设备进行调试，并组建了网庭微信工作群，将合议庭成员、审判辅助人员、技术人员及当事人等相关人员加入该群，提前引导、帮助当事人下载、安装、注册、登录及操作、应用互联网庭审系统。
上午10点15分，全部诉讼参与人均已到位，设备运行全部正常，画面清晰，声音响亮。随着审判长宣布调解开始，“云间”调解正式启动。在调解过程中，原、被告双方均充分发表了各自的调解意见，并在合议庭的主持下，双方当事人均表达了最大的和解诚意。经过一个多小时的调解，双方当事人对于和解的基本方向、和解方案的思路达成了初步共识。随后，在合议庭的引导下，当事人对调解笔录进行了仔细核对，并通过电子签名进行了确认，合议庭成员、书记员也通过扫码进行了签名确认。“云间”调解顺利完成，全程无接触，安全又高效。
此次“云间”调解，是海口知识产权法庭顺应时代需要，充分利用互联网庭审技术开展司法审判工作的一个重要举措。在未来的工作中，该庭会继续充分运用新时代智慧法院建设成果，建设智慧法庭，服务好人民群众，让广大人民群众能切实享受到“智慧”办案带来的成果。
Haikou Intellectual Property Court urged to promote online mediation mode to balance case hearing and epidemic control
Dressed in a robe and facing the screen, judges in Haikou IP court were hearing civil cases without a plaintiff, defendant or lawyer in attendance on Feb 27. It was an online trial. All these cases concerned infringement of design patent disputes and the trial went on for more than one hour, with all legal procedures completed on line. After the trial, two parties got agreements and judges sent the conciliation statements by mail immediately. “I did not expect the court could settle the case in such a short time," the plaintiff sang very high praise for this new trial model，“Now, I can resume my work smoothly .Thanks to the IP court ‘s trial innovation and efficiency.”
Aims to better meet people’s judicial needs and ensure smoothly and orderly operation of courts despite the coronavirus outbreak, Haikou IP court has been mobilizing to promote and improve online litigation services.The app is called Yunshenpan which literally means “trial in the cloud”. It combines all kinds of high technologies, such as voice, video recording, recognition, electronic files, case records and intelligent analysis and so on. The APP can even support eight people at most to communicate by video at the same time during the trial. Although it looks complicated, it is very easy to use. Before hearing, judge assistant first got the litigants' approval to use the platform and taught them to install software on a laptop or download a smartphone application. It only took them about two or three minutes to log in to the system, and both of the litigants could talk with each other and also with judge online quickly. Besides case hearing, litigants submit material, case filing, ruling delivery are all acceptable through this app.
During the special period, Haikou IP court has been trying all the best way to avoid risks of epidemic spread, as well as to adjudicate cases efficiently and ensure the parties' legitimate interests.
